1.1. By accessing a website operated by START Global (including START Hack, START Summit, START Sphere and START Fellowship), a student-led club at the University of St. Gallen, you declare that you have understood and accept the following General Terms and Conditions. START Global exclusively signs contracts, which are subject to these General Terms and Conditions. Every contractual party (including any purchaser of a ticket or registering for an event or conference organized by START Global) is agreeing to comply with and be bound by these General Terms and Conditions.

1.2. Furthermore, these General Terms and Conditions govern the relationship between START Global and: (i) natural persons and legal entities who reserve, order, or receive tickets through START Global; (ii) natural persons, legal entities, and public entities or corporations that entered into a Partnership or Investment Agreement with START Global; (iii) visitors who view, read or use products, pages or other services provided or offered by START Global.

1.3. These General Terms and Conditions shall apply to the entire range of offers available at www.startglobal.org of START Global and contracts signed or agreed with START Global. Our purchase policy shall also apply to any bookings by telephone, email or in person bookings. Before concluding the order, you will confirm that you took notice of General Terms and Conditions applicable at the time and agree to them by purchase of the ticket or by oral, written, or digital confirmation. START Global reserves the right to amend and/or remove these General Terms and Conditions as well as any other information or content of the website at any time, to any extent, and without prior notice.

2.1. We care about data privacy and security. Please review our Privacy Policy, in which START Global describes the collection, processing, and use of your personal information. By using the site, the Participant agrees to be bound by START Global’s Privacy Policy, which is incorporated into these General Terms and Conditions.

2.2. Please be advised that the site is hosted in Switzerland. If you access the site from any other region of the world with laws or other requirements governing personal data collection, use, or disclosure that differ from applicable laws in Switzerland, then through your continued use of the site, you are transferring your data to Switzerland, and you expressly consent to have your data transferred and processed in Switzerland.

3.1. The ticket prices on the START Global websites are inclusive of value-added tax (where applicable). START Global may change prices at any time. All prices are understood to be in CHF.

3.2. Discounted tickets are only valid in combination and/or in conjunction with an authorized identification qualifying for discount.

3.3. START Global reserves the right to refuse any order placed through the website. START Global may in sole discretion limit or cancel quantities purchased per person, per household, or per order. These restrictions may include orders placed by or under the same account, the same payment method, and/or orders that use the same billing or shipping address. We reserve the right to limit or prohibit orders that, in START Global’s sole judgement, may appear to be placed by dealers, resellers, or distributors.

3.4. START Global uses third party service providers to provide an event platform service and uses the following service providers: (i)brella (ii)accelerator app limited (iii)discord. Use of these services is subject to their own terms and conditions and privacy policies.

4.1. START Global uses third-party providers to provide secure online payment services and accepts following forms of payment: (i) PayPal, (ii) Stripe (iii) b2match. The use of those services is subject to their own terms and conditions and privacy policy. All payments shall be made in CHF.

4.2. The Participant agrees to provide current, complete, and accurate purchase and account information for all purchases made via START Global. The Participant further agrees to promptly update account and payment information, including email address, payment method, and payment card expiration date, so that START Global can complete the transactions and contact the Participant as needed.

5.1. The Participant assumes sole responsibility for the visit of the event. START Global cannot be held liable for indirect and/or consequential loss suffered by the Participant, including, but not limited to loss of earnings, loss of chance, loss of profits, loss of clients, loss of data, any financial or commercial loss, any commercial disadvantage, or any non-material damage.

5.2. START Global cannot be held liable if failure or partial failure to fulfill its obligations under the General Terms and Conditions is attributable (i) to the Participant, or (ii) to the unforeseeable and unavoidable act of a third party unconnected with the provision of the services specified in the General Terms and Conditions as well as in further agreements between the Participant and START Global or (iii) to a force majeure event.

5.3. START Global is unable to promise the Participant that the event will fully meet his expectations or that no errors will occur while using the website or participating in the event. Failures in the provision or an interruption of the event shall not result in a claim for reimbursement of the ticket price or any other claim of the Participant.

5.4. START Global reserves the right to refuse admission to any event, format or conference for any behavior, which it deems unacceptable, or for breach of the General Terms and Conditions.

5.5. The website is available 24 hours a day, 7 days a week, subject to closure for maintenance or repair or in the case of a force majeure event or any event that is beyond the control of START Global. START Global cannot be held liable for any loss or harm suffered by the Participant or by any third parties as the result of failure to (i) access the website, (ii) the internet, (iii) the communication media, and (iv) more generally, due to a force majeure event, as defined in the case law of the Swiss courts, during a visit to the website.

5.6. START Global shall not be held liable for damage caused by using the internet such as data loss, cyber-attack, computer virus or downtime.

5.7. START Global shall not be held liable for any unauthorized use of the website and/or other inline services by the Participant or by any other third party. If a liability claim were to be brought against START Global on the grounds of breach by the Participant of any of the provisions of the General Terms and Conditions, START Global will be entitled to bring third-party proceedings against the Participant.

5.8. The Participant acknowledges and agrees that they are solely responsible for the manner in which they order and receive the ticket. This responsibility includes providing accurate information during the purchase process, safeguarding the ticket from loss or damage once received or collected, and complying with event-specific rules and regulations. START Global is not responsible for any issues or delays related to ticket delivery. Refunds and exchanges are subject to these General Terms and Conditions.

6. LIMITATIONS REGARDING THE TRANSFER OF TICKETS AND PROHIBITION OF COMMERCIAL USE

6.1. No part of our website may be used for any commercial purposes, unless with the prior written consent of START Global. Any commercial resale of tickets is prohibited. You agree that you will not use the ticket you have purchased for advertising, marketing (this also includes sweepstakes and other contests) or other commercial purposes or sell them in front of the access or entrance area of the venue. Moreover, START Global reserves the right to block your access or not to accept the ticket order if Start Global reasonably suspects that you have used automatic programs for ticket ordering or have ordered tickets above START Global’s admissible maximum number of tickets per person.

6.2. The tickets purchased are for your own personal use or that of your business only and may not be re-sold, forwarded or transferred for commercial gain under any circumstances. Where there has been any re-sale or attempted re-sale of any tickets (or any other breach of this General Terms and Conditions), we reserve the right to cancel the relevant tickets with immediate effect.

6.3. START Global reserves the right to cancel any contract with you in case of violation against the General Terms and Conditions. Such a violation can lead to the right to enter the respective event being revoked. Furthermore, in case of a violation against these General Term and Conditions, and if the right of cancellation has been exercised, the Participant shall incur a contractual penalty in the amount of the ticket price along with administrative fees.

6.4. No part of the matchmaking application, format application or event platform provided by START Global may be used for commercial purposes without the prior written consent of START Global. It is also forbidden to advertise your business outside your own booth (e.g. by distributing flyers over a large area).

7. SPECIAL PROVISIONS FOR PERSONALIZED TICKETS

7.1. Tickets are personalized, meaning that only the person holding visiting rights has the right to demand access to the event. That person’s name is a component part of the ticket. The legal validity of the transaction depends on the immediate, truthful, and timely provision of the various names of ticketholders upon purchase, as the tickets will be issued immediately following the purchase process in the names that you provided. It is not possible to transfer or re-personalize your ticket to another person.

Should any provisions of these General Terms and Conditions or contents of an addendum to these General Terms and Conditions integrated be deemed invalid whole or in part, this shall not affect the validity of the remainder of these General Terms and Conditions. Invalid provisions shall be replaced by valid provisions which come as close as possible to the intended economic and legal purpose of the invalid provisions. The same shall apply to any unintended omission.

These General Terms and Conditions and all contractual relationships with START Global shall be governed exclusively by Swiss law. The jurisdiction for all disputes arising from or in connection with this contract is St. Gallen, Switzerland. Contract language is English or German.

START Global may, at any time, and at sole discretion, modify these General Terms and Conditions, including the Privacy Policy, with or without notice to the Participant. Any such modification will be effective immediately upon public posting. The Participant’s continued use of service and this website following any such modification constitutes an acceptance of these modified terms.

Additionally, we collect and process the following personal data about applicants to our formats and programs:  their personal details, contact data, application documents (e.g. letter of motivation, CV, certificates of employment, diplomas, letters of reference, etc.).

We collect and store the names of our alumni, along with their contact data (such as their postal address, e-mail address and telephone number), information about their employment at our organization and thereafter, and other information that we receive from them.

Furthermore, photographs and video recordings will be made at the events of START Global. These will be used for public relations work (including social media) and will also serve to permanently document the events (offline and online and can thus also be accessed outside Europe). 

Finally our website server temporarily saves information about your use of our website. Such information includes, among other things, the IP address, date and time of access, the name and URL of the file opened, the website from which the access is made, the browser used (including the version), the operating system (including the version) of the computer used and the name of the user’s access provider. We may collect non-personal identification information about Users whenever they interact with our Site. Non-personal identification information may include the browser name, the type of computer and technical information about Users’ means of connection to our Site, such as the operating system and the Internet service providers utilized and other similar information.

Our Site may use “cookies” to enhance User experience. Users’ web browser places cookies on their hard drive for record-keeping purposes and sometimes for tracking information about them. To control applications: Whenever you apply for a position at START Global or to one of our programs and formats (Side Events, Workshops, Speed Dating etc.)  you are obligated to share certain personal data to us. By submitting your application, you make it possible for us to use and examine that information so that we can invite you to an application interview and decide whether you are suitable for the position. 

We do not share this information with outside parties except to the extent necessary to provide the service. To send periodic emails we may use the email address to send User information and updates pertaining to their order. It may also be used to respond to their inquiries, questions, and/or other requests.

We adopt appropriate data collection, storage and processing practices and security measures to protect against unauthorized access, alteration, disclosure or destruction of your personal information, username, password, transaction information and data stored on our Site. We use a CRM and several APIs to connect to third party providers for mailing, data collection, payment method, for accounting etc.

We may share generic aggregated demographic information not linked to any personal identification information regarding visitors and users with our business partners, trusted affiliates and advertisers for the purposes outlined above. We may use third party service providers to help us operate our business and the Site or administer activities on our behalf, such as sending out newsletters or surveys. We may store your information with these third parties for those limited purposes.

PRIVACY POLICY FOR THE USE OF GOOGLE ANALYTICS AND ADWORDS

We use a tool called Google Analytics. This tool uses so-called „cookies”, text files which are being stored on your computer and enable the analysis of your usage of the website. Only you can prevent your browser software from storing cookies. In order to do this, you have to change your settings although some features will be deactivated. 

PRIVACY POLICY FOR THE USE OF FACEBOOK AND INSTAGRAM ADS USING FACEBOOK PIXEL

We use "Facebook Pixel" on our website, a service of Meta Platforms Ireland Ltd, 4 Grand Canal Square, Grand Canal Harbour Dublin 2, Ireland (hereinafter referred to as: "Facebook / Instagram").

If you have given us your consent in accordance with Art. 6 Para. 1 lit. a GDPR, we use Facebook Pixel for marketing and optimisation purposes, in particular to place relevant and interesting ads for you on Facebook and Instagram and thus improve our offer, make it more interesting for you as a user and avoid annoying ads.

Facebook Pixel makes it possible to display our ads on Facebook and Instagram, so-called "Facebook/ Instagram ads", only to those Facebook and Instagram users who were visitors to our website, in particular who have shown interest in our online offer. In this case, Facebook Pixel also makes it possible to check whether a user was redirected to our website after clicking on our Facebook/ Instagram ads. Facebook Pixel uses, among other things, cookies, i.e. small text files that are stored locally in the cache of your web browser on your end device. PRIVACY POLICY FOR THE USE OF LINKEDIN TRACKING PIXEL

We use the conversion tracking technology and the retargeting function of LinkedIn Ireland Unlimited Company, Wilton Place, Dublin 2, Ireland on our website. This enables us to play personalised advertisements on LinkedIn to visitors to our website. For this purpose, a cookie, LinkedIn Insight-Tag, is set in your browser with a validity of 120 days, which enables LinkedIn to recognise you if you visit this website and are logged into your LinkedIn account at the same time. LinkedIn uses this data to create anonymous reports on the performance of the advertisements as well as information on website interaction. The information generated by the cookie is usually transferred to a server in the USA and stored there.

The legal basis for the processing is your consent in accordance with Art. 6 para. 1 lit. a GDPR.

On our website we use the MATEO web widget (hereinafter "WebChat") of the company: MATEO Estate GmbH c/o Factory Berlin, Lohmühlenstraße 65, 12435 Berlin 

Users can use our WebChat like a contact form to chat with us. When you use the MATEO WebChat on our website, the following personal data is processed: The date and time of the call, browser type and browser version, your IP address, the operating system used, URL of the previously visited website, your first and last name, your e-mail and content sent by you. Depending on the course of the conversation in our WebChat, further personal data may be processed if you provide it. The nature of this data depends on your request or the problem you describe to us. When you access the website, the chat widget is loaded in the form of a JavaScript file from Supabase. The chat widget is the source code that runs on your computer and enables you to chat with us. ‍The purpose of the processing is to use the data recorded via WebChat to process and respond to your enquiries. Your personal data will not be transferred to third countries.

Alternatively, your data will be deleted as soon as the purpose of the processing no longer applies and, in the case of statutory retention periods, the data will be blocked for further use until the retention period has expired.
